Pollard charged with sexual assault

Former Banks County fire chief Gary Pollard has been charged with sexual assault following allegations from an inmate who said he raped her.

A Banks County grand jury indicted Pollard Monday on one count of sexual assault against a person in custody. The grand jury dismissed the rape charge.

Dana Maloch, an inmate at Lee Arrendale Correctional Institute in Alto, filed a federal lawsuit against Pollard earlier in connection with the allegations. Maloch said she was on a work duty at the Banks County Fire Department when the alleged incident occurred. In the lawsuit, the woman claims that Pollard kissed and touched her inappropriately several times and then “raped” her in July 2008.

“Defendant Pollard told the plaintiff never to say a word and that it would be her word against his and nobody would believe an inmate,” the lawsuit reads. “She was afraid to tell anyone of the rape and just went around crying all the time until the warden sent her to mental health. Then, the facts of the rape came out.”

Maloch also filed a lawsuit against former board of commission chairman Gene Hart and commissioners Rickey Cain and Joe Barefoot. The inmate claims that they were warned not to hire Pollard because he was discharged from a previous position because of sexual harassment of female employees.

Maloch is seeking compensatory and punitive monetary damages but a specific amount is not listed in the lawsuit. She is also asking for a jury trial.

Indicted !!! Indicted !!! Where is the RA RA squad now ? I thought they were saying this was thrown out of court, WRONG !!! I thought they were saying the DA wasnt sending this forward cause there wasnt enough evidence, WRONG !!! Its the same old Gene Hart, Robin Trotter, Ricky Cain, Joe Barefoot supporters that took up for Pollard from the start. Let me guess, theres not enough evidence now either ?? WRONG !! He is going to jail, where he should be, this is a felony, he has disgraced this county !!! And he should be in jail. I just wonder how much money this is going to cost us this time, he never should have been hired here !!!

Our constitution states that all are innocent until proven guilty. If he's convicted, nail him to the wall-hard. No mercy for sexual crimes. Mercy produces repeat offenders. Until then, don't conduct a trial in the press.
